In this update:
- Formal merger clearance process available
- On 1 January 2007 amendments to the Trade Practices Act 1974 commenced establishing a new "formal" process by which companies may seek clearance of their proposed acquisition from the ACCC. The ACCC has recently released its Formal Merger Review Process Guidelines providing guidance on how the ACCC will process and respond to applications for formal clearance.
