Law NEWS - Viptel Mobile phone telemarketers misled consumers

The Federal Court in Darwin has declared that VIPtel Mobile has engaged in multiple breaches of the Trade Practices Act 1974 during telemarketing calls to promote mobile services in the Northern Territory.

The Australian Competition and Consumer Commission (ACCC) took VIPTel to the Federal Court after a number of complaints from remote indigenous communities. VIPtel's claims included that calls to any mobile or landline would be charged at the cost of a local call, customers would pay no more than a capped monthly fee and network coverage was available Australia-wide.

Customers who had been contracted to 24 month commitments while living in areas without network coverage will receive refunds and be able to cancel contracts with no penalty as a result of the ACCC action.
