Law NEWS - Environmental Law Update - Xstrata Greenhouse Update

In this update:

- Xstrata Greenhouse Appeal - Case sent for re-hearing

The Queensland Court of Appeal decided unanimously that fundamental problems in the way the Queensland Land and Resources Tribunal dealt with greenhouse-related objections when it decided an application by Xstrata for new mining rights at the Newlands coal mine mean that the objections have to be re-heard.

At 3.42pm today the Queensland Premier and the Queensland Mines Minister issued a joint press release saying that the State Government would legislate next week to guarantee operations at Xstrata's operations as a result of the ruling (referred to in the attached 'Environment Alert') that "on a legal technicality, could have stalled the mine's further development".
