Law NEWS - The Office of the Privacy Commissioner comments on fax spam
In response to the Department of Communications, Information Technology and the Arts (DCITA) Discussion Paper on "Fax Spam", the Office of the Privacy Commissioner (the Office) has issued a public submission. The Office considered that it is unlikely that most cases of unsolicited commercial faxes would fall under the ambit of the Privacy Act 1988 (Cth) as the information used to send them is not typically "personal information". Therefore the Office suggested that fax spam should be regulated, either under the Spam Act 2003 (Cth) or the Do Not Call Register Act 2006 (Cth). Such regulation could require that an effective unsubscribe mechanism be included with commercial faxes and could ultimately reduce the number of unwanted commercial messages sent by fax.
