Legal NEWS - Privacy Commissioner acknowledges progress made with second draft of Access Card Bill
The second exposure draft of the Human Services (Enhanced Service Delivery) Bill 2007 contains a number of welcome privacy protections according to Privacy Commissioner, Karen Curtis. Ms Curtis commented favourably on the proposed oversight mechanisms, the provisions on confidentiality, the limits on disclosure and the intention that the Act should be interpreted to limit its impact on privacy.
The Privacy Commissioner also made recommendations to the Department of Human Services including that:
- the photograph on the card's surface should be made optional;
- the Bill's Administration Rules should be clarified;
- civil remedies should be created for when Access Card information is mishandled; and
- there should be a regular statutory review mechanism for the card.
